Where there were similar houses with which the bouse in question could be compared, then the rating authority would have no right—and 'his Lordship used the words “no right” in the sense which he had mentioned above—■to go beyond that. Here the arbitrator found as a fact, whether rightly or wrongly was not material, that he could not arrive at the annual value of the house without ascertaining the trade done therein. By this finding he made the case an exception within the meaning of the decision in “ Dodds v. South Shields Union.” The arbitrator, therefore, very properly considered that this was a house which would do a certain amount of business, and he had arrived on proper grounds at the rateable value. Hare Hatch, Berks—The Hawthorns, F he was wrong in so holding, then the assessment should be reduced to £240 gross estimated rental, and £192 rateable value. He also held that the second contention of the appellant was wrong in■ law7. If he was wrong in so holding, then the assessment should he reduced to £680 gross estimated rental, and £544 rateable value. If he was wrong in rejecting the evidence referred to in the first contention of the respondents, then the Court was either to remit the case •to him or to make such other order as it should think fit. He also found that the second contention of the respondents was true in fact, and in arriving at this■ conclusion he took into account the value of the “ goodwill,” using that word as bearing the second meaning stated above, and he ordered that the appeal Should be dismissed. He also held that the third contention of the respondents u7as correct, and he further held that, although the profits of trade (as such) could not. he rated, yet in estimating th- rateable value of a public-house, if the ability to carry on a gainful trade therein added to the value of such public-house, that value could not be excluded merely because it was referable to the trade, ■and he considered that he was warranted in so holding by the decision in “Reg. v. Grand Junction Railway Company” (4 Q.B., 18). The Divisional Court affirmed the decision of the arbitrator and gave judgment for the respondents. The appellant appealed to the Court of Appeal. The evidence in the case and the award of the arbitrator, Mr. Walter C. Ryde, were reported in ■the Estates Gazette of January 29, and March 5, 1898. The experts giving evidence for the appellants w7ere:—Mr. Edward J. Lowther, A.R.I.B.A. (of Messrs. Gordon and Lowther, surveyors, Blomfield-street, E.C.) ; Mr. Frederick S. Broderick, F.S.I., of Hull ; and Mr. Walter Barnett, rating surveyor, Winchester House, E.C., Who put the gross value at about £300, and the rateable at £250. On behalf of the Union, Mr. William H. Wellsted, F.S.I., of Manor-street, Hull ; Mr. John Hopper, J.P., F.S.I., of Leeds; and Mr. Charles Gott, F.S.I., of Bradford, were called, and estimated the gross at about £850, and £680 net. Mr. Balfour Browne, Q.C., and Mr. Cautley (instructed by Messrs. Rollitt and Son, Hull) represented the appellants and the Hull Licensed Victuallers’ Protection Society ; Mr. R. M. Bray, Q.C., Mr. R. Cunningham Glen and Mr. H. Brent Grotian (instructed by Messrs. Chatham and Son, Hull) appeared for the Union. Mr. Balfour Browne, Q.C., contended that the house should be valued without reference to the goodwill and trade already done there, and cited the Mersey Docks case, of 1873 ; “The Queen v. Aylesford Union ” ; “ Dodds v. South Shields Committee ” ; “ Bradford-on-Avon v. White ” ; and Mr. Cantley, who cited “ L.C.C. v. City of London Brewery,” said red, green and black balls were dropped in a 1bag by a witness for the Union in ■order to calculate the takings from every man, woman and child entering the house. In answer to the Lord Chancellor, Mr. Bray defined the distinction between trade actually done and trade already done as being in the former case the quantity of trade, and the latter that a large trade had been done there for 20 years. The Court dismissed the appeal. The Lord Chancellor said the problem to be determined was what rent a tenant from year to year would give for the premises. Towards the solution of that problem all that might reasonably affect the mind of a tenant from year to year would be material to ,be considered. He would make one general observation in regard to the decisions, apart from any reference to any particular case. In giving advice to justices at quarter sessions, where these cases usually came from, phrases had been used by learned Judges which might at first l>e considered as decisions upon the law of evidence. It would be wrong to consider them as such. They were merely intended to be advice as to what should form the topics for the consideration of the justices and as to the mode in wliich such-and-such a fact should be considered. One of those pieces of advice was not to roam over a man’s books, as, in the words of Lord Esher, M.R., in “Dodds v. South Shields Union,” such a proceeding would be oppressive and unfair. It was not necessary here to consider any such case. The arbitrator had properly received ■and acted upon the evidence. His Lordship did not think that, in coirsidering the question whether the public-house was a good business house, it was inappropriate to show that the house was full of cus־-tomers every day. To permit evidence to be given as to the capacity of the house for business, and at the same time to sav that that fact could not■ be put to the test in the best way possible, did not seem intelligible to him. That was not going into a man’s profits. So here, to show that a number of brewers’ drays brought a certain number of casks of beer to the public-house was one way of Showing that it was a good house for business. To his mind that was the law, apart from any authority. As regards the case of “Dodds v. South Shields Union,”
