BROMLEY COUNTY COURT. January 31. (Before His Honour Judge Emden.) A CLAIM FOR COMMISSION. CHATTELL V. STONEHAM. This was an action by Mr. H. J. Chattell, auctioneer, etc., Chislehurst, to recover commission on the disposition of the lease of a house at Chislehurst. Mr. Frederick Mote (instructed by Mr. F. Gissing Skelton) said some of the terms were admitted, but the point at issue was what scale of commission should be paid for getting ■the assignment of the lease. The charge was at the rate of 5 per cent, on the first year’s rent, 2i per cent, on the second year’s rent, and 5 per cent, on the premium of £300. The lease had ll¿ years to run and the rental was £225. A copy of the terms was sent to the defendant at the time of the transaction, and there had been a lot of correspondence. For the defence, Mr. S. 1). Stoneham submitted that it was not a rack rental lease. Mr. D. J. Chattell gave evidence in support of the claim, and said the charge was the invariable one in the profession. A copy of the register specifying the charges was sent to the defendant.
