His Honour Judge Bonsey, sitting at the Auckland County Court on the 6th inst., heard an action in which John Dent Chipchase, of Darlington, and William Walker, of Cockfield, colliery owners, sought to obtain an injunction against John Teasdale, miner, of Foxhall, Copley-lane> Butterknowle, restraining him, his servants, and agents from further wrongfully working any mines or seams of coal lying under lands in the parish of Lynesack and Softley, and under lease to the plaintiffs. There was also a claim for the sum of £50 as damages for such wrongful working. Plaintiffs were lessees under the Ecclesiastical Commissioners of a certain area called the Butterknowle for a period of 10 years from January 1, 1910. For the defence, it was stated that since the plaintiffs took their lease there had been no violation of the terms of the award under which coal was reserved to the Ecclesiastical Com- missioners. During the miners4 strike an old heap was discovered, and it was claimed by the defendant that it was not a seam of coal which came under the terms of the lease. Eventually defendant consented to judgment being given against him for £10 damage without an injunction, and to give an undertaking not to work the coal. COAL. IRON AND ENGINEERING COMPANIES. Aiton and Co.
